
JOINT STATEMENT OF THE PARTIES
Erik Marcus of Erik's Diner Podcast and Vegan.com and George Lambert, the proprietor of Podkeyword.com and Podkey.com, have resolved their dispute concerning Lambert's creation of an alternative RSS-feed to Marcus' "Erik's Diner" podcast.
Media and members of the blogging and podcasting communities have commented widely on the technical and legal issues raised by this dispute, and the specific allegations that Marcus and Lambert lodged against each other. Marcus and Lambert, therefore, jointly provide this notice to inform the community of their mutual agreement to resolve their dispute.
As part of the settlement, Marcus and Lambert have worked out a method by which Marcus will hopefully regain his lost audience. Further, Lambert has agreed to inform the public clearly of Podkeyword's "terms of service" on the Podkeyword websites (www.podkeyword.com and www.podkey.com). Lambert will also inform all current Podkeyword/Podkey users of the service's terms by e-mail. All current users who wish to continue with the service must opt-in to the service within 14-days of the e-mail notice. Users who do not opt-in to the service will receive a redirect (in the form of an http 301 redirect) from the podkeyword.com RSS feed to the podcast's official RSS feed for three months, after which time the user's podkeyword.com URL may be reassigned.
All other terms of the parties' settlement are confidential.
